Policy on sexual harassment
Introduction:With regard to the Supreme Court judgment and guidelines issued in 1997 to provide for effective enforcement of basic human right of gender equality and guarantee against sexual harassment of women at work place, the UGC has issued circulars since 1998 to all universities to establish a permanent cell and a committee to develop guidelines to combat sexual harassment, violence against women. Keeping with the above guidelines Morigaon College has constituted a committee against Sexual Harassment.
Based on the land mark judgment by the Supreme Court of India in August 1997 which states that every instance of sexual harassment is a violation of Fundamental Rights under articles 14,15 and 21 of the constitution of India. Gauhati University to which Morigaon College is affiliated made it mandatory for affiliated colleges to adhere to the following:-
1.An anti-sexual harassment cell to be made functional with at least two senior women faculty on the committee.
2.An affidavit to be submitted by each college declaring that such a policy is adopted and anti-sexual harassment cell is operative.

Objective:
1.To fulfill the directive of Supreme Court, as per UGC directives and the Gauhati University in respect of implementing the policy against sexual harassment in the institution.
2.To evolve a mechanism for prevention and redressal of sexual harassment case and other gender violation in the college.
3.To create and maintain a secured environment which is free from gender based discrimination.
4.To prepare a detailed plan of action, both short and long term.
5.To promote social and psychological environment that will raise awareness against sexual harassment in the various form.

Definition:
Sexual harassment includes any one of the following-
1.Physical contact and advances.
2.Demand or request for sexual favours.
3.Sexually coloured remarks.
4.Showing pornography.
5.Any other unwanted physical, verbal or non-verbal conduct of sexual nature.

Scope:
This policy shall be applicable to all complaints of sexual harassment made
1.By a member of the college against any other member of the institution of harassmentis within the campus.
2.By an outsider against a member of the college or amember of the college against an outsider if harassment is within the campus.
3.By a member of the college against an outsider if harassment is outside the campus.

Composition of the committee:
a.A presiding officer who shall be a senior women faculty.
b.Not less than two teaching employees and two non-teaching employees.
c.Student representative.
d.One member from amongst non-governmental organization.

The committee is responsible for:

*Investigating every formal written complaints of sexual harassment.
*Taking appropriate remedial measure to respond to any substantiated allegation of sexual harassment.

Grievance Redressal Mechanism:
1.The committee shall meet as and when any complaint is received by it. Any member of the committee can receive the complaint.
2.The committee may direct the accused to prepare and submit a detailed statement of the incident if written complaint lacks exactness within a period   of 7 days.
3.The committee shall direct the accused to prepare and submit a written response to the complaint within a period of 7 days.
4.Each party will be provided with a copy of the written statement submitted by the other.
5.The committee allows both parties reasonable opportunity of presenting their case with relevant document and witness. If accused is not present, committee shall continue ex parte.
6.The committee sits on a day to day bases to record and consider evidence produce by both parties.  Proceedings shall take place in the presence of both parties.
7.Minutes of all proceedings of the committee shall be prepared and duly signed by the members of the committee and complete it within a period of 10 days from the date of receipt of complaint.
8.The committee shall record its findings in written supported with reason and shall forward the same with its recommendation to the Principal/GB within a period of 15 days.
9.If in the course of proceedings before it, the committee is satisfied that sexual harassment is made out against  the accused and there is any chance of recurrence of any such action disciplinary action could be initiated in the form of-
a.Warning.
b.Written apology.
c.Bond of good behavior.
d.Adverse remarks in the confidential report.
e.Debarring from supervisory duties.
f.Denial of membership of statutory bodies.
g.Denial of reemployment/readmission.
h.Stopping of increments promotion.
i.Reverting,demotion.
j.Suspension.
k.Dismissal.
l.Any other relevant mechanism.

If the culmination of the proceedings before it the committee is satisfied that the complaint has knowingly brought false charges of sexual harassment against any person it shall report the same in writing to the Principal/GB with reason and with recommendation of the action to be taken against such person.
